These terms define the contract between plainlight., in the following also referred to as "we" or "us", and its customers, "you", for the purpose of purchasing photography prints from this website.
plainlight. exclusively offers for sale prints of photographic images created by Juri Wornowitski. The purchase provides you with a partial, non-exclusive right to use the images under the description of "fair use". No part of the copyright is transferred with the purchase.
You order with plainlight., Juri Wornowitski, Schiersteiner Str. 37, 65187 Wiesbaden, Germany.
You express your intention to order a print from this site by choosing an image, its dimensions, finish and frame, and by clicking on Request a quote button on the dedicated page. This request doesn't constitute any obligation on your part and only serves as means of preparation a specific buying offer for your intended purchase.
This offer will be sent to you by email within 48 hours after your quote request submission. Along with the complete price, including that for several alternative options, you will be provided with a link to a custom page created for your intended order. You can finalise configuration of your print and pay for the order on this page only.
The fact of payment completion creates a contract between you and plainlight. to deliver your ordered print against the made payment.
plainlight. reserves the right to reject orders resulting from fraudulent manipulation of the ordering process.
Some prints may be offered as limited editions with only a designated number of copies being sold. This number will be announced together with the initial proposition. plainlight. guarantees that no print copies will be produced beyond this limit, less up to 5 (five) test prints which won't be subject to sale under any circumstances.
Limited editions can only be proposed for images either unavailable for sale otherwise, or offered in a different rendering, e.g., a black-and-white edition of a colour image, or an original rendering of a colour image otherwise sold in black and white.
plainlight. expressly reserves the right to restrict dimensions and/or finishing and framing options for limited editions.
Quotes for limited editions will be provided in the order of incoming request submissions, as long as the number of sold prints will stay below edition's limit. It is possible that offered quotes will outnumber the available prints. In this case, the time of actual order payment is deciding for honouring the order. Payments made after the last limited print had been sold will be immediately refunded.
The final prices comprise manufacturing costs, author's fee, and shipping charges.
Within the EU, German VAT of 19% is levied on production and delivery costs. For other destinations, customs and other import fees may apply.
Payment for orders is possible in euros and U.S. dollars and provided through services of PayPal, Inc. Your purchase is covered by the latter's Protection Policy.
Fulfilment and delivery of orders are conducted by AVENSO GmbH, Berlin, Germany.
plainlight. delivers through services of AVENSO GmbH, Berlin, Germany using DHL, FedEx, TNT, or UPS to following destinations:
Countries not on the list can not be served. Delivery is only possible to street addresses, and has to be signed for.
Under normal circumstances, delivery will take 1 to 3 working days to most destinations. In any case, you will be provided with a tracking link for your shipment.
After the delivery took place, a signed Certificate of Authenticity for your purchased print / edition will be mailed to the same address by registered post.
Certificates issued to buyers of limited edition prints additionally include the designated print number along the total number of prints, including test prints, in the edition.
As items produced to your individual specifications, prints are exempt from returns unless defective or damaged in transit.
Please check your delivery in the presence of the delivery person. If you notice damage, you should refuse receipt. Then, please contact us to order a replacement. To allow a quick handling of the situation, it is helpful if you can provide photographic documentation of the damage.
If you have already received the work before you notice damage, please contact us as soon as possible. Production and in-transit defects have to be declared to the manufacturer within 1 week after delivery. plainlight. can therefore only pursue such claims if they are brought to our attention immediately on the day of delivery or during 4 subsequent days. Please keep the original packaging in case a return is necessary.
If you get unhappy with your purchase for whatever other reason, or after the time period mentioned above, you can contact us and request the refund of author's fee within 1 year after delivery. In this case, you also will be eligible for one order at half price (except delivery charges). You will be asked to return your Certificate of Authenticity before the refund can be granted.
These terms are subject to change whenever legal requirements demand so. If some of these provisions become obsolete due to changed laws or other reasons, the rest will stay effective until further notice.
